The Role of the Expert in Asset Recovery

Daniel Barton, Partner, and Luke Steadman, Partner, Alvarez and Marsal, London, UK

The use of forensic accountants as Expert Witnesses in litigation and arbitration to provide independent opinions on value, loss and damage is commonplace in all but the smallest matters. Although appointed generally by one side in a dispute, our work and views have to be independent of the interests of the party that pays our fees. This independence is restated by us in every report and in the UK is enshrined in the Civil Procedures Rules Part 35. Although not part of arbitration rules, we use this same 'gold standard' of independence in our approach and evidence in all aspects of Alternative Dispute Resolution.
