Re Noble Group Limited [2018] EWHC 2911 (Ch)

Edoardo Lupi, Barrister, South Square, London, UK

Synopsis
Snowden J convened a single meeting of the scheme creditors (apart from one creditor, which, it was agreed, should vote in its own meeting) in respect of a scheme of arrangement proposed for an international company, which had shifted its COMI to this jurisdiction. In so doing, the Judge gave some important guidance on the approach to be taken towards class composition, the proper approach in respect of fees paid to scheme creditors, and practical guidance on the timing of documents to be filed with the Court.
