How Technologies and Innovation Are Driving Chinese Insolvency Law Developments: New Supreme People’s Court Bankruptcy Information Platform

China’s rapid acceptance and use of technology and the internet in all aspects of life, including its legal system, continues to drive innovations. This article introduces the the National Bankrupt Enterprise Reorganisation Cases Information Platform (全国企业破产重整案件 信息平台, 'Information Platform') which commenced operation on 1 August 2016 in China and analyses its potential impact. The article argues that the comprehensive Information Platform has the potential to dramatically change insolvency law and practice in China based on more transparency and access to information, but challenges remain which will be the focus of future research efforts.
The Information Platform is funded and maintained by the powerful Supreme People’s Court of the People’s Republic of China based in Beijing. To promote the smooth operation of the Information Platform, the Supreme People’s Court also formulated and released
Provisions on Information Disclosure in relation to Enterprise Bankruptcy Cases (Trial Implementation) ( 关于企业破产案件信息公开的规定(试行)), Operational Measures for the Enterprise Bankruptcy Cases Judges Work Platform (Trial Implementation) (企业破 产案件法官工作平台使用办法(试行)) and Operational Measures for the Enterprise Bankruptcy Cases Bankruptcy Administrators Work Platform (Trial Implementation) (企业破产案件破产管理人工作平台使 用办法(试行)) on 26 July 2016, effective 1 August 2016. The Information Platform is published in the Chinese language and is yet to offer functionality in other languages.
