In recent years, a combination of factors including the 2019 EU Directive on preventative restructuring frameworks, concerns around recognition of restructuring processes in overseas jurisdictions and the 'rule in Gibbs', have contributed to a surge in the number of 'multi-process' restructurings, in which restructuring tools across multiple jurisdictions are used to implement a restructuring of a single corporate group. This article explores why the restructuring landscape has changed in this way and the benefits from, and challenges of, multi-process restructurings.
