Synopsis
The Preventive Restructuring Directive 2019 presents two main actors in its framework for restructuring a viable debtor with the aim of preventing its insolvency: the debtor in possession and the practitioner in the field of restructuring. Minimum norms are introduced for shaping their roles in preventive restructuring proceedings. This contribution studies the role that both the debtor in possession and the practitioner in the field of restructuring have been given in the Directive and how it impacts the governance of preventive restructuring proceedings.
