An appeal was dismissed in circumstances where a contractual obligation to pay royalties did not survive the sale of the business by administrators. There was no express or implied term obliging the procurement of a purchaser to be bound by a continuing obligation to pay royalties. The administrators had carried out their duties in good faith and no unfair harm had been caused.
