The High Court granted an application by the defendant receivers (the 'Receivers') to strike out a damages claim brought by the claimant, Denaxe Limited ('Denaxe'). The Court considered in detail the extent of immunity conferred on trustees or office-holders who have obtained Court sanction for their decision to enter into a particular transaction. It held that immunity extended to claims for breach of statutory and common law duties of care and was not limited to claims for breach of fiduciary duty.
