It is now more than two years on from the entry into force in June 2020 of the Corporate Insolvency and Governance Act 2020 and the shiny new toy it bestowed upon restructuring professionals, the exciting restructuring plan ('RP'), is developing nicely. After a somewhat slow start, the stream of RP cases is gathering momentum, providing increasingly clear guidance on the court's approach. In this article, we take stock of some of the key themes emerging from the case law so far.
