Construction and Improvement of Chinese Bankruptcy Legal Framework for Micro and Small Enterprises in China: Problems and Proposals

China's existing Enterprise Bankruptcy Law 2006 has practical shortcomings in the scope of application of the insolvency regime and the provisions on reorganisation. This has led to the judicial dilemma that micro and small enterprises (MSEs), a vital part of China's economic development, are caught in the difficulties of bankruptcy. Therefore, constructing the Chinese bankruptcy legal system for MSEs has important social and judicial implications. Chinese legal scholars and practitioners are expected to establish a simplified and applicable insolvency regime that meets the characteristics of MSEs.
