Immovable Properties in International Insolvencies: UK Supreme Court Clarifies

The Supreme Court has held that English courts cannot provide assistance at common law to a foreign bankruptcy trustee in relation to immovable properties in England and Wales expanding the established rule that such properties do not automatically vest in a foreign bankruptcy trustee irrespective of the position under foreign bankruptcy law. However, such assistance can be provided under section 426 of IA1986 or the Cross-Border Insolvency Regulations 2006.
