Impact of an (English) Worldwide Freezing Order on German Clawback Provisions

Payments of a debtor which are made under the impression or pressure of an enforcement under an (English) Worldwide Freezing Order can be considered as 'incongruent' transactions within the meaning of section 131 of the German Insolvency Code. This means that they can be challenged under very low conditions in a later insolvency of the debtor. This even applies in cases where a declaration of enforceability of the Worldwide Freezing Order has not yet been issued in Germany.
