The recent High Court decision in Re Changtel Solutions UK Ltd (In Liquidation) [2022] EWHC 694 (Ch) provides helpful guidance on void payments under section 127 of the Insolvency Act 1986 ('Section 127 IA').
In particular, the case considered the bases on which parties might be able to retain an otherwise void payment under Section 127 IA, including the availability of a change of position defence. Ultimately, the court will need to be satisfied that it is just in all the circumstances to deviate from usual pari passu principles to not require repayment of a void payment caught by Section 127 IA.
