Re Swiss Cottage Properties Limited (in liquidation) [2022] EWHC 1495 (Ch)

Charlotte Schofield, Associate, and Pamela Gorska, Trainee Solicitor, Freshfields Bruckhaus Deringer LLP, London, UK

Synopsis
This case concerns the sale of two unique properties and raises points on valuation techniques in respect of unusual assets, the treatment of creditors without a real ‘economic interest’ in administration, and inaccuracies in administrators’ Statements of Proposals.
The High Court judgment highlights that the Court will take a pragmatic approach to mere technical deficiencies in administrators’ conduct, whilst reminding administrators to get their messaging to the creditors clear and consistent.
